Clayberry Town — Terms of Use

1. Agreement

These Terms govern the Clayberry Town app for iOS and Android (the "App") published by Appfide Private Limited ("Appfide," "we"). By downloading or using the App, you (the parent or guardian setting it up) agree to them. The App Store's Licensed Application End User License Agreement or Google Play's Terms of Service also apply; where they conflict with these Terms on how the App is licensed through that store, they prevail.

2. For Children, Set Up by Grown-Ups

The App is made for young children to play. A parent or guardian is responsible for setting it up, for any purchase, and for the child's use of the device. Purchases, settings and external links are behind a parental gate.

3. What's Free

Every game's "Easy-peasy" levels are free, without ads, for as long as we offer the App.

4. Berry Club — Auto-Renewing Subscription

Berry Club is an optional auto-renewing subscription offered yearly and monthly. It unlocks the "Just right" and "Super tricky" levels of every game, and new games and levels as we add them, as described in the App's Berry Club page when you subscribe.

  • Free trial. Where offered (yearly plan, new subscribers), you are not charged during the trial. Unless you cancel at least 24 hours before it ends, the subscription starts and you are charged at the end of the trial.
  • Payment is charged to your Apple Account or Google Play account when you confirm the purchase (after the free trial, if you have one).
  • The subscription renews automatically at the end of each period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
  • You can manage or cancel at any time in your store account settings, or from the App's grown-ups' area (Berry Club → Manage subscription). Cancelling stops future renewals; Berry Club stays on until the end of the period you paid for.
  • Deleting the App does not cancel a subscription.
  • Unlocking a device needs an internet connection once, and our server checks that the purchase is valid and that the App is a genuine copy on a genuine device. After that the App plays offline. One subscription can unlock a reasonable number of devices in a family; we may limit unusually many.
  • On the App Store, Family Sharing is on: family members in your Family Sharing group can use Berry Club too.
  • Prices are set in your local currency by the store and may include taxes. We will tell you about any price increase in advance, as the store requires.

5. Refunds

Purchases are processed by Apple or Google, and refunds are handled by them under their own policies. To ask for a refund, use reportaproblem.apple.com for App Store purchases, or Google Play's order history. If a purchase is refunded, Berry Club ends on your devices. If something isn't working, please write to us first at [email protected].

6. Acceptable Use

You may use the App for personal, non-commercial learning. You may not copy, modify, reverse-engineer, or redistribute the App or its content, get around its subscription checks, or share unlocked content, except as the law expressly allows.

7. Our Content

The App's games, characters (including Berry), art, voices, music and words are owned by Appfide or our licensors. Fonts and other open-source components are listed in the App under About → Licences.

8. Third-Party Services

The App relies on third-party services, including Apple (the App Store and App Attest), Google (Google Play and Play Integrity), Cloudflare and DigitalOcean. Their availability is outside our control, and their own terms apply to your use of their services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. The App supports learning at home and is not a substitute for teaching or professional advice. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPFIDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

11. Changes and Termination

We may update the App and these Terms. Material changes will be posted here with a revised "last updated" date and, where appropriate, noted in the grown-ups' area. If we ever discontinue the App or Berry Club, we will give reasonable notice where we can.

12. Governing Law

These Terms are governed by the laws of India. Disputes will first be attempted to be resolved through good-faith negotiation, and otherwise by arbitration under the Arbitration and Conciliation Act, 1996, seated in Ernakulam, Kerala, India, in English. This does not deprive you of the protection of mandatory consumer laws in the country where you live.
