1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Appfide Private Limited ("Appfide," "we," "us," or "our"), a company incorporated under the Companies Act, 2013 with its registered office at XXI/152 Panadans, Cochin University Post, Ernakulam – 682022, Kerala, India.

By accessing or using our websites (including appfide.com), mobile applications available on the Apple App Store and Google Play Store, APIs, and any related services (collectively, the "Services"), you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, you must discontinue use of the Services immediately.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Services, you represent and warrant that you meet the eligibility requirements.

3. User Accounts

  • Certain features require you to create an account using email/password, Apple Sign In, Google Sign In, or other supported authentication methods.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or compromised.
  • You may delete your account at any time through the in-app settings or by contacting us at [email protected].

4. Subscriptions & In-App Purchases

4.1 Subscription Plans

Certain Services offer premium features available through auto-renewing subscription plans (weekly, monthly, quarterly, or annual). Subscription pricing is displayed in the applicable app or website at the time of purchase and may vary by region.

4.2 Billing & Renewal

  • Mobile (iOS & Android): Subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Web: Subscriptions purchased through our website are processed via Stripe, Razorpay, or other designated payment processors. Renewal charges are applied automatically to the payment method on file.
  • Prices may change with reasonable notice. Price changes will take effect at the start of the next billing cycle following the notice.

4.3 In-App Purchases

One-time in-app purchases (e.g., consumable credits, premium content unlocks) are non-refundable except as described in our Refund Policy or as required by applicable law or platform policies.

4.4 Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable fee.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful, fraudulent, or malicious purpose.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Services.
  • Circumvent, disable, or interfere with any security, access control, or rights management features.
  • Scrape, crawl, or use automated means to access or collect data from the Services without our written permission.
  • Transmit viruses, malware, or any other harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Upload, post, or transmit content that is defamatory, obscene, abusive, infringing, or otherwise objectionable.
  • Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
  • Create multiple accounts to abuse promotions, free trials, or to circumvent restrictions.

6. Intellectual Property

  • All content, features, functionality, software, designs, trademarks, and trade names associated with the Services are the exclusive property of Appfide Private Limited or its licensors and are protected by Indian and international intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
  • You retain ownership of content you submit through the Services, but you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display such content as necessary to operate and improve the Services.

7. Third-Party Services

The Services may integrate with or contain links to third-party services, including payment processors, analytics providers, advertising networks, and social media platforms. Your use of such services is governed by their respective terms and privacy policies. Appfide is not responsible for third-party content, services, or practices.

8. Analytics, Crash Reporting & Performance Monitoring

We use third-party services such as Firebase Analytics, Firebase Crashlytics, Google Analytics, and Mixpanel to collect usage data, crash reports, and performance metrics. This data helps us improve the quality, stability, and performance of the Services. For details on what data is collected, please refer to our Privacy Policy.

9. Advertising & Tracking

The Services may display advertisements from third-party advertising networks. We may use advertising identifiers (IDFA, GAID) for ad attribution, campaign measurement, and — with your consent — personalised advertising. You can opt out of personalised ads through your device settings. See our Privacy Policy for details.

10. Contact Form & Consent

By submitting the contact form on our website and checking the "I agree" checkbox, you:

  • Consent to the collection of the personal data you provide (name, email, phone, subject, and message) as well as technical metadata (IP address, browser type, device information, screen resolution, timezone, referrer URL, and network information) as described in our Privacy Policy.
  • Acknowledge that this data is used to process your enquiry, prevent spam and abuse, and improve our services.
  • Confirm that you have read and agree to these Terms & Conditions and our Privacy Policy.

We use Google reCAPTCHA v3 to protect the contact form from spam. By using the form, you also agree to Google's Terms of Service and Privacy Policy.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPFIDE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of, or inability to use, the Services;
  • Any unauthorised access to or alteration of your data;
  • Any third-party conduct on the Services;
  • Any interruption or cessation of transmission to or from the Services.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to Appfide in the 12 months preceding the event giving rise to the claim, or INR 5,000, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold harmless Appfide and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

14. Termination

  • We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice.
  • Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.
  • You may terminate your account at any time. Termination does not entitle you to a refund of any prepaid fees, except as stated in our Refund Policy.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a new "Last updated" date and, where appropriate, providing notice through the Services or via email. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Ernakulam, Kerala, India. The language of arbitration shall be English, and the decision of the arbitrator shall be final and binding.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Appfide with respect to the Services and supersede all prior agreements, understandings, and representations.
