Squiggloo — Terms of Use

1. Agreement

These Terms govern the use of the Squiggloo mobile application (the "App"), published by Appfide Private Limited ("Appfide," "we," "us"). By downloading or using the App you agree to them. If you do not agree, do not use the App.

The App is distributed through the Apple App Store, and your use of it, including the Squiggloo PRO subscription, is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). Where these Terms and the Standard EULA conflict, the Standard EULA prevails to the extent of the conflict.

Our handling of data is described in the Squiggloo Privacy Policy.

2. Parents and Guardians

Squiggloo is for all ages. When a child uses it, a parent or guardian accepts these Terms on the child's behalf, decides whether to buy Squiggloo PRO, and is responsible for any purchase. Purchases, settings and links that leave the App are behind a parental gate.

3. What Squiggloo Does

Squiggloo is a coloring app for iPhone and iPad. It offers coloring pages in categories, loaded from our server (an internet connection is needed to load them), creative tools to color them, a "Make Your Own" feature that turns a photo into a coloring page on the device, a My Art gallery and Save to Photos. The pages and tools on offer may change over time.

4. Squiggloo PRO — Auto-Renewing Subscription

Squiggloo PRO is an optional auto-renewable subscription, offered monthly, every 3 months and yearly. It unlocks stickers, rainbow color, gradient and pattern fills, the color mixer and custom colors, the eraser, Make Your Own photo pages and unlimited undo. Without it, the App offers solid fills and five undos per page.

In the United States the prices are US$4.99 a month, US$11.99 for 3 months and US$29.99 a year. Prices vary by country, are set in your local currency by Apple, may include applicable taxes, and are shown in the App before you subscribe.

• Payment is charged to your Apple ID when you confirm the purchase.
• Your subscription renews automatically at the end of each period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within the 24 hours before the period ends.
• You can manage or cancel the subscription in your Apple ID settings (on iPhone or iPad: Settings → your name → Subscriptions). Cancelling stops future renewals; PRO stays on until the end of the period you have paid for.
• Deleting the App does not cancel a subscription.
• To unlock PRO again after reinstalling or on another device, use Restore Purchases in the App's Settings with the same Apple ID.
• We will tell you in advance of any price increase as Apple requires.

5. Refunds

All purchases are processed by Apple, and refunds are handled by Apple under its own policies. To request a refund, use reportaproblem.apple.com. If something is not working, contact us first at [email protected] — we can often put it right.

6. Coloring Pages, Artwork and Photos

• The App and its coloring pages are owned by Appfide or its licensors. You may color them and keep and share the pictures you make for personal, non-commercial use.
• Photos used with Make Your Own are converted on the device and never uploaded. You are responsible for having the right to use the photos you choose.

7. Acceptable Use

You agree not to copy, resell or redistribute the App or its coloring pages, and not to reverse engineer, tamper with or try to bypass the App's purchase system or use automated means to access our servers.

8. Third-Party Services

The App relies on Apple (the App Store and payments) and Cloudflare (our server). Their availability is outside our control, and their own terms apply to your use of their services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPFIDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

11. Termination

You may stop using the App and delete it at any time. We may end access if these Terms are breached or if we discontinue the App. If we discontinue the App, we will give reasonable notice where we can.

12. Changes to These Terms

We may update these Terms. Material changes will be posted here with a new date. Continuing to use the App after a change means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Disputes will first be attempted to be resolved through good-faith negotiation, and otherwise by arbitration under the Arbitration and Conciliation Act, 1996, seated in Ernakulam, Kerala, India, in English. This does not deprive you of the protection of mandatory consumer laws in the country where you live.
